1. Scope

These terms apply to the VocaLoom app and related services (“VocaLoom”, “we”), offered by the operator named in the legal notice. By using VocaLoom you accept these terms. If you download VocaLoom from the Apple App Store, Apple’s Licensed Application End User License Agreement (EULA) also applies; if there is a conflict regarding the licence to the app, Apple’s EULA prevails.

2. The service

VocaLoom helps you learn vocabulary with flashcards and a five-box spaced-repetition system. You can add words by typing, pasting text or from photos; flashcard content can be generated automatically. Studying and reviewing your saved words works offline on your iPhone.

3. Accounts

4. Free plan, credits and invitations

5. Premium subscriptions and payment

6. Fair use

Automatic translation, flashcard generation and photo recognition cause real costs for every request. They are provided for personal language learning. Use that clearly exceeds normal personal learning — in particular automated, bulk or commercial use — may be limited, also for Premium.

7. Misuse, suspension and termination

You may not misuse VocaLoom. Misuse includes in particular:

If there are reasonable indications of misuse, we may, at our discretion and where possible after weighing your legitimate interests, without prior notice:

Benefits obtained through misuse are not compensated. If we terminate an account with a paid Premium subscription because of misuse, any refund is made only under section 8; beyond that you have no further claims arising from the termination — in particular no claim to continued access, compensation or damages — except where mandatory law provides otherwise. We may also terminate the use of VocaLoom for any user with reasonable notice; in that case section 8 applies to the unused paid period.

8. Refunds

9. Your content and AI-generated content

10. Availability and changes

We work to keep VocaLoom available but cannot guarantee uninterrupted service; maintenance, updates or problems with third-party services may cause interruptions. Studying your saved words keeps working offline. We may develop and change features. We will inform you in good time about changes to these terms that affect you; continued use after a change becomes effective means acceptance, unless mandatory law requires otherwise.

11. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence we are liable only for breach of an essential obligation (an obligation whose fulfilment makes proper use of the service possible and on which you may regularly rely), limited to the typical, foreseeable damage. Otherwise our liability is excluded. Free services are provided as they are.

12. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer-protection rules of the country where you live remain unaffected. Nothing in these terms limits your statutory rights as a consumer. If any provision is invalid, the remaining provisions remain in force. The EU Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr; we are not obliged and not willing to take part in dispute resolution proceedings before a consumer arbitration board.
